The home concession
If you will live in the home, the home concession applies a rate of $1.00 for each $100 to the first $350,000 of the value, with the standard rates applying to the balance. You must move in within one year of settlement and not sell or lease any part of the property before you do, or within the first year of living there.

Worked examples
An established home bought for $750,000 as an investment: $17,325 plus 4.5 per cent of the $210,000 over $540,000, which is $9,450, so $26,775. The same home bought to live in, with the home concession: $3,500 on the first $350,000, plus $6,650 on the value from $350,000 to $540,000, plus $9,450 on the balance, so $19,600. The same home bought by an eligible first home buyer: a reduced amount on a sliding scale, because $750,000 sits between the $700,000 full concession and the $800,000 phase-out. A new home bought by an eligible first home buyer at any price: nothing.
First home buyers
For an existing home, the first home concession removes duty entirely on a home valued up to $700,000 and phases out between $700,000 and $800,000. For a new home (one that has not been previously occupied or sold as a place of residence) and for vacant land to build a first home on, transactions entered into on or after 1 May 2025 attract no transfer duty at all, with no value cap. For vacant land bought before that date, or where the new home rules do not apply, the first home vacant land concession applies up to $350,000 and phases out to $500,000. To qualify you must be an individual aged 18 or over who has never held an interest in a residence anywhere in the world, you must pay market value, and you must move in within one year of settlement (two years for vacant land, once the home is built) and not dispose of any part of the property before moving in or within the first year. For agreements from 1 August 2026, buyers must be Australian citizens, permanent residents or specified foreign retirees to claim a home concession. We lodge the concession with the transfer so it is assessed correctly.
When duty is paid
Transfer duty is due within 30 days of the contract becoming unconditional (or of the contract date if there are no conditions), and in practice it is paid at settlement through PEXA. Unlike New South Wales, there is no deferral for off-the-plan purchases; duty is assessed on the full price.
Other concessions and exemptions
Transfers between spouses and de facto partners of the home they live in can be exempt, as can transfers following a relationship breakdown and transfers to beneficiaries of a deceased estate. Each has its own conditions and we assess them when preparing the transfer.
Frequently asked questions
Is stamp duty included in my conveyancing fee?
No. Duty is a government charge paid to Queensland Revenue Office. Settle Easy's fixed professional fee covers the legal work; we calculate the duty, lodge any concession and pay it through settlement.
Do first home buyers really pay no duty on a new home?
For transactions entered into on or after 1 May 2025, an eligible first home buyer of a new home or vacant land to build on pays no transfer duty, whatever the price, provided they meet the residence and other conditions.
Can I get the home concession on a property I will rent out?
No. The home concession and first home concession require you to live in the home within one year of settlement and not lease it before then or within the first year.
