What we do for Victorian buyers and sellers

For buyers: a review of the contract and the section 32 vendor statement within 48 hours before you sign, advice on the three-business-day cooling-off period and the finance clause, the certificates the vendor statement does not cover, the owners corporation certificate for apartments and townhouses, liaison with your lender, the land transfer duty assessment and any first home buyer or principal place of residence concession, the statement of adjustments, and settlement on PEXA. For sellers: the contract of sale and the section 32 prepared with the certificates the Sale of Land Act requires, advice on any section 27 deposit release, answers to the buyer's questions, the discharge of your mortgage, and settlement. The Victorian buying guide sets out every step; the Victorian fees page sets out every cost.

Melbourne

Melbourne's apartment market makes the owners corporation certificate as important as the title: levies, the maintenance fund, any special levies for cladding or defects, and the rules. In the inner suburbs, heritage overlays and the planning scheme decide what you can do with a house, and we read the overlays with you before you sign. Auctions are the norm in much of Melbourne, and there is no cooling-off period at auction or in the three business days either side, so the review, finance and inspections come first.

Geelong, the Surf Coast and the Bellarine

Buyers moving from Melbourne often sell at the same time; we line up both settlements. Coastal and Surf Coast land carries bushfire management and erosion overlays that show in the planning certificate, and some Bellarine estates have design covenants on the title.

Ballarat and Bendigo

The goldfields cities have older housing stock and, in places, heritage overlays and mining-era titles; the building inspection and the title plan both earn their keep. Growth estates on the edges of both cities bring house-and-land contracts with their own timing and duty questions.

The Mornington Peninsula and the south-east

From Frankston through Mornington, Hastings and Bittern to the growth corridors of Cranbourne, Pakenham and Dandenong, the mix runs from coastal holiday homes to new estates. Septic systems, bushfire overlays and green wedge zoning on the Peninsula, and developer covenants and sunset clauses in the estates, are the things we check first.

Regional Victoria

We act across the state: Shepparton, Mildura, Warrnambool, the Latrobe Valley, Seymour, Wodonga and everywhere between. Rural and lifestyle properties bring water rights, on-site waste water, access and farming zone questions. On the Murray, Wodonga is in Victoria and Albury is not; the state decides the law, the duty and the cooling-off rules, and we act in both.

A lawyer-led firm at a conveyancer's price

Settle Easy is an incorporated legal practice. Your matter is handled by a licensed conveyancer or a property lawyer, and if it stops being routine, a lawyer is already on the file. Every matter is managed online with a named person as your point of contact.

Frequently asked questions

Does my conveyancer need to be in the same suburb as the property?

No. A conveyancer licensed in Victoria can act on any property in the state, and the process from signing to settlement is electronic. What matters is that they know Victorian law, the section 32 and the local planning overlays.

How long does conveyancing take in Victoria?

The settlement period is set in the contract; 30, 60 and 90 days are all common. A contract and section 32 review takes one to two business days.

Can you act if I live interstate or overseas?

Yes. Identity verification, signing and settlement are all done online, and we work with your lender wherever it is.
